These Terms of Service (“Terms”) govern your access to the Observagent website and waitlist. By accessing the website or joining the waitlist, you agree to these Terms. If you do not agree, do not use the website or submit the form.

1. About this website

Observagent is developing tools intended to help organizations understand, improve, and optimize AI systems. This website provides general information and allows interested users to request updates. Joining the waitlist does not create a customer relationship, guarantee access, reserve a specific position, or commit Observagent to launch any product, feature, price, or timeline.

2. Eligibility and accurate information

You must be at least 13 years old and legally able to agree to these Terms. You agree to provide an email address you are authorized to use and not to impersonate another person or submit information without permission.

3. Communications

By joining the waitlist, you expressly consent to receive launch updates and related Observagent communications at the email address submitted. You may unsubscribe at any time using the link in an email or by contacting support@observagent.cloud. Our handling of personal information is described in our Privacy Policy.

4. Acceptable use

You may not:

  • use the website for unlawful, fraudulent, abusive, or harmful activity;
  • interfere with the operation or security of the website or attempt unauthorized access;
  • use automated systems to submit forms, scrape the website, or burden its infrastructure without permission;
  • introduce malware or malicious code; or
  • misrepresent your relationship with Observagent.

5. Intellectual property

The website and its content, including the Observagent name, logos, graphics, text, design, and software, are owned by or licensed to Observagent and are protected by applicable intellectual-property laws. Except for ordinary personal viewing, you may not copy, modify, distribute, sell, license, or create derivative works from the website without prior written permission.

6. Third-party services and links

The website relies on third-party services, including Brevo, Google reCAPTCHA, and website hosting providers, and may link to external websites. Their services and content are governed by their own terms and policies. Observagent is not responsible for third-party websites or services that it does not control.

7. Website changes and availability

We may change, suspend, or discontinue the website, waitlist, content, or anticipated product plans at any time. We do not guarantee uninterrupted, secure, or error-free access.

8. Informational content

Website content is provided for general informational purposes and may be incomplete, preliminary, or become outdated. It is not professional, legal, financial, security, or technical advice and should not be relied upon as such.

9. Disclaimers

To the maximum extent permitted by applicable law, the website and waitlist are provided “as is” and “as available,” without representations, warranties, or conditions of any kind, whether express, implied, statutory, or collateral, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or availability. Nothing in these Terms excludes rights or warranties that cannot lawfully be excluded.

10. Limitation of liability

To the maximum extent permitted by applicable law, Observagent and its personnel will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or business opportunity, arising from or related to the website or waitlist. Where liability cannot be excluded, Observagent’s aggregate liability relating to the website will not exceed CAD $100. These limitations do not apply where prohibited by law.

11. Indemnity

To the extent permitted by law, you agree to indemnify and hold Observagent harmless from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website or material breach of these Terms.

12. Governing law

These Terms are governed by the federal laws of Canada and the laws of the Canadian province or territory in which Observagent principally operates, without regard to conflict-of-law principles. Applicable consumer-protection rights and mandatory local laws remain unaffected.

13. General

If a provision is found unenforceable, the remaining provisions remain effective. Our failure to enforce a provision is not a waiver. You may not transfer these Terms without our consent. We may update these Terms by posting a revised version and date. Continued use after an update constitutes acceptance of the revised Terms.
